General Conditions
The Atelier WOCS is a company founded in the village of Saint-Cergue in the middle of the Jura Mountains in 2018. Since 2020, Atelier WOCS is located in Geneva city. 
 
Conditions of use
The Atelier WOCS is a registered company in the Canton of Geneva, located on Place du Molard 3, GE-1204, Switzerland.




The terms, policies and conditions (collectively known as “Conditions”) described below govern the use of this site (referred to as “WOCS” or “Atelier WOCS” or boutique or “site”). Your use and/or placement of any order indicate your acceptance of these Conditions.
 
1. PRIVACY
We guarantee the privacy of your personal information. Your data will only be used to inform you of our offers and will not be given, sold or otherwise transferred to a third party except our e-commerce platform host Shopify Inc. (https://www.shopify.com/legal/privacy) and for legal obligations or to deliver goods ordered. We keep your personal information private and secure. When you make a purchase from our boutique, you provide your name, email address, credit card information, address, phone number, and a password. We use this information to process your orders, to keep you updated on your orders and to personalize your shopping experience. Our secure servers protect your information using advanced encryption techniques and firewall technology. To keep you informed about our latest offers, we may notify you of current promotions, specials and new additions to the Atelier WOCS site. You may unsubscribe from our newsletters by following the unsubscribe instructions in any email you receive from us. We use “cookies” to keep track of your current shopping session to personalize your experience and so that you may retrieve your shopping cart at any time. Privacy on Other Web Sites Other sites accessible through our site have their own privacy policies and data collection practices. Please consult each site’s privacy policy. Atelier WOCS is not responsible for the actions of third parties.
 
2.SHIPPING

Products in stock: Orders received before 3:00 PM will usually ship within the next 2 working days, provided the product ordered is in stock. Orders received after 3:00 PM will usually ship within the next 3 business days. N.B. Orders are not processed or shipped on Saturday or Sunday, except by prior arrangement.

Framed Artworks: If your artwork is not backed and if in accordance with your order it should be mounted, then a 12-15 days delay will be necessary in order to proceed with the backing process. In the case of business partners holidays or any event that could delay your shipping, you will be informed immediately.

You will receive the shipping information on the day of your package’s departure.

Shipping method

Switzerland: Small shipments are made by Swisspost and will arrive in one to two working days. Large shipments are made by FedEx or DHL depending on order. .

International: Shipments are made by FedEx(framed artworks) or DHL(rolled artworks) and will usually arrive within 5 to 10 business days. Note these transit times are estimates and may vary.

Shipping prices

Shipping Charges are indicated below the product price. Atelier WOCS (www.wocs.ch) cannot be held responsible if delivery is unduly delayed because of local customs. Tariffs, duties and local taxes in the recipient’s country, if applicable, are born by the Customer.



3. RETURN POLICY
If you have any issues with your delivery please contact us at art(@)wocs.ch and we will do our best to sort it out for you. Atelier WOCS will gladly accept returns and issue and on-line store credit or refund the item. Items to be returned or exchanged must be returned in perfect, unopened, new condition, with all original tags and stickers attached. You have 7 days from receipt of your order to request a return through the contact form. Note, that you must ship the item back to us with a copy of your order confirmation 7 days from date your request is approved. Packages sent without contacting us beforehand will not be accepted for a refund. Atelier WOCS will not be responsible if the addressee is not present at the time of delivery and/or if the Customer (or the person designated by the Customer) does not pick up the Products at the carrier’s office, after the Carrier delivers a note to the addressee.


4. MULTIPLE PRODUCT ORDER
For a multiple product order, we will make every attempt to ship all products contained in the order at the same time. If you order multiple artworks with wooden art crates, we will craft a larger sur-mesure wooden crate to fit several artworks.

5. ORDER ACCEPTANCE POLICY
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Atelier WOCS reserves the right at any time after receipt of your order to accept or decline your order for any reason or to supply less than the quantity you ordered of any item.

6. PRICES AND TERMS OF PAYMENT
Prices displayed on the site are exclusive of certain taxes and other expenses (VAT, shipping charges, tariffs, insurance, local and/or excise taxes). The final price of the products the Customer intends to order is indicated on the summary screen of his order. Prices are subject to change without further notice and are not guaranteed. Atelier WOCS will inform the Customer of any change in price prior to any new order. Atelier WOCS will accept the Order and subsequently ship the products to the Customer only after payment has been successfully processed and approved. Consequently, the Customer always prepays for the products. The products are exclusively paid by credit card, PayPal or BVR (Switzerland only). However, corporations/companies based in Switzerland may pay by invoice (15 days). The Customer may print the invoice online once the order is shipped. Credit Cards We accept the following credit cards: Visa, MasterCard, AMEX and Apple Pay. There is no surcharge for using your credit card to make purchases with WOCS. Please be sure to provide your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay in processing your order.


Invoice payment

The amount invoiced shall be paid in accordance with the payment terms recorded in the invoice. The order confirmation email is considered as the official date of invoice. 

In the event of default in payment, default interest at the rate of 5% will be applied. In case of a reminder, you will also be charged an administration fee of CHF 30.

Non-payment of due invoices, or any other circumstances that indicate that the customer's net worth situation has considerably deteriorated after the conclusion of the contract shall, at our option, entitle us to declare all our claims immediately due and postpone all our obligations in relation to this customer until our claims have been fully paid or until all contracts not yet fully performed have been rescinded, and to assert damages for the loss ensuing from failure of the contract.

In the event of default, the customer shall reimburse us for the reminder and debt collection charges resulting to us, insofar as thes are necessary for pursuing our rights. Moreover, anyfurther loss, including in particular any loss arising due to correspondingly higher interest on any credit accounts of ours as a result of non-payment, shall be reimbursed, regardless of who is at fault for default in payent.



7. RESPONSIBILITY
The Customer is responsible for his own choice of artwork and after delivery, the preservation of his artwork. The Customer is responsible for the payment of all tariffs, duties or local taxes if applicable in the recipient’s country.




8. GUARANTEES
Atelier WOCS assures that the artworks are printed according to strict standards of quality and preservation according to the standards of Swiss museums. However, Atelier WOCS will not guarantee the artworks if the Customer does not meet the optimum conditions of preservation of the artworks.


Conditions of preservation

Light: Light could cause chemical changes in many materials used in our artworks. Sustained exposure to ultra violet rays found in natural light is the most damaging. We suggest to minimise natural daylight and use light which filters out UV.

Temperature and relative humidity: A constant climate is the ideal situation for keeping works of art stable. The standard temperature for keeping your artworks safe is 20ºC ± 1ºC. The accepted standard for relative humidity is 50% ± 3%. Fluctuations in temperature and humidity set up cycles of expansion and contraction which will inexorably lead to the deterioration of artworks.

Dust: Dust is composed of minute particles including some hard substances that can scratch artwork if rubbed against the surface of a painting. Some types of dirt, including insect debris, can contain acidic components which eat into the artwork surface. Similarly, industrial air pollutants can affect the artwork or the finish on a frame. It is important to keep artworks free from dust and dirt and away from air pollutants.

Physical vibration or impact: Always transport your artworks in protective crates to reduce vibration from movement and shock. The best option if you are going long distances or have large artworks is to use a removal company specialising in art transport.

Stretching and framing: Please use only acid free framing and mounting materials. Make sure that your artwork is stretched and framed correctly and fitted with a safe hanging system which is appropriate for the weight of the work. Poor stretching can result in an inappropriate degree of tautness and deformation of the frame support. If it is on a rigid support, ensure that the hanging system does not endanger the artwork or the support. Frames generally protect works of art. It is important that a conservation standard backboard be fitted to the frame. This will reduce damage from changes in the environment, poor handling and airborne pollutants and dust.

Hanging: For example, a painting hanging in a bathroom will be subjected to fluctuating conditions of temperature and humidity. If the moisture content of the air is high enough mould growth will flourish, resulting in disfigurement of the image and in many cases a permanent change in the artwork surface. Not all damage is treatable, so it is best to take preventive action and hang your artwork away from outside walls, direct sunlight or spotlighting, water pipes and splashing, wet or very dry areas, high traffic areas such as hallways where contact with the painting may occur, open fires, gas fires and heating/cooling ducts, tobacco smoke and food preparation areas.

Deteriorated or damaged artworks: If your artwork does sustain damage or is in a deteriorated or dirty condition, don’t attempt to repair or clean it yourself. Artwork surfaces are extremely vulnerable to hands touching (use gloves), water and other cleaning agents which may damage them irreparably. Get in touch with Atelier WOCS for any query or seek advice from a local professional art framer.


9. TAXES
Atelier WOCS shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within Switzerland. For orders shipped to other Countries, you are solely responsible for all sales taxes or other taxes.


10. TYPOGRAPHICAL ERRORS
In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Atelier WOCS shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Atelier WOCS shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Atelier WOCS shall immediately issue a credit to your credit card account in the amount of the incorrect price.

This site may contain links to other sites on the Internet that are owned and operated by third parties. You acknowledge that WOCS is not responsible for the operation of or content located on or through any such site.

13. APPLICABLE LAW AND COMPETENT JURISDICTION
The law applicable to the present Terms of Sale is governed under Swiss law. If the customer is a corporation, all disputes related to the present Terms of Sale will be submitted to the exclusive competence of the courts of the jurisdiction of Geneva, Switzerland.


14. OTHER CONDITIONS
These Conditions will supersede any terms and/or conditions you include with any purchase order, regardless of whether Atelier WOCS signs them or not. Atelier WOCS reserves the right to make changes to this site and these Conditions at any time.
